Sesgos periciales y justicia en el Sistema de la Técnica Criminalística

La validez del dictamen pericial se ve amenazada por sesgos cuya génesis es multifactorial; trasciende el marco cognitivo individual, para arraigarse en dinámicas organizacionales y presiones del contexto investigativo. Este artículo pretende analizar cómo pueden influir los enfoques cognitivos, organizacionales y contextuales para ofrecer una explicación del problema y proponer un conjunto de transformaciones que permitan mitigar sus efectos en el sistema judicial cubano. Mediante una revisión teórica integradora de la literatura especializada y un análisis estratégico, permite advertir que la praxis pericial en el Sistema de la Técnica Criminalística nacional puede verse afectada. Los resultados demuestran que las interacciones entre las limitaciones naturales del pensamiento humano, la influencia de la estructura de las instituciones y las presiones situacionales de la investigación pueden incidir en la generación de sesgos de confirmación, anclaje y autoridad. La mitigación exige, desde el punto de vista ético y jurídico, la combinación de reformas organizacionales, la implementación estricta de protocolos de análisis ciego, la revisión por pares independientes y la incorporación obligatoria de la metacognición en la formación profesional de los operadores del sistema. Se incita a institucionalizar la humildad cognitiva para elevar la validez, objetividad y la justicia, conforme a Derecho.
