GENDER VIOLENCE: BETWEEN WATCH AND PUNISH

Abstract
Gender violence is a problem of complex analysis and comprehensive solutions. Its treatment from the perspective of Criminal Law goes through two response models; one that locates in the text of the penal regulations the tools for the punishment of the manifestations of this type of violence, and another that transfers the content of the crimes and other penal institutions to the so-called special laws, comprehensive laws or gender laws. Any of them intend to punish violent acts permeated by discriminatory expressions based on gender. The article that is presented intends to expose the main transformations that the Cuban penal substantive legislation received in matters of gender and family violence, keeping due coherence with the constitutional text and the other norms, always in search of a comprehensive and integrated response.
