THE EFFECTIVE JUDICIAL PROTECTION IN CRIMINAL PROCEEDINGS

Abstract
The right to effective judicial protection is a historical product of the development of society and legal awareness; its recognition in the supreme law placed man on a higher level of respect for his dignity and, at the same time, generated a change in his living conditions and social relations, This paper explores conceptual aspects of this institution which, in a novel way, foresaw the right of individuals to access judicial bodies, to obtain judicial review of their rights and legitimate interests, and made the State responsible for creating the appropriate scenario and establishing a procedural channel in order to resolve the conflict on an equal footing. This imposes new challenges for the administration of justice, particularly in the criminal sphere, due to the impact of new demands on the professional performance and ethical behavior of judges, which requires actions to strengthen their performance as decision-makers, guarantors of society, legal security and the full realization of the human personality.
